The Executive Branch has made official the state of emergency declaration for the districts of San Martin de Porres and San Juan de Lurigancho, both located in the Peruvian capital, Lima.
Likewise, the Government mandated that this measure be applied in the districts of Sullana, Bellavista, Marcavelica, Salitral, Querecotillo, Ignacio Escudero, and Miguel Checa, situated in the province of Sullana (Piura region).
It should be pointed that the state of emergency was declared as a measure to confront delinquency and organized crime in the above-mentioned jurisdictions.
The mandate indicates that social events and shows are suspended in these places between midnight and 4 a.m.
The legal provision indicates that the state of emergency implies "the restriction or suspension of the exercise of constitutional rights relating to the inviolability of homes, freedom of assembly, as well as personal freedom and security."
Said rights are included in subsections 9), 11), 12), and 24), as well as in paragraph f) of Article 2 contained in Peru's Political Constitution.
Specific actions
The intervention of the
Peruvian National Police (PNP) and the Armed Forces in the above-mentioned jurisdictions will take place in accordance with the provisions of Legislative Decree No. 1186, which regulates police use of force, and Legislative Decree No. 1095, which establishes rules for the use of force by the Armed Forces in the national territory and its Regulations, approved by Supreme Decree No. 003-2020-DE.
The document states that the
Ministry of Interior will manage the National Police's actions, together with the National Superintendence of Migrations and the National Superintendence for the Control of Security Services, Arms, Ammunition and Explosives for Civilian Use (Sucamec).
Moreover, the Interior sector will coordinate with regional and local governments to take administrative control measures in public transportation, including small vehicles, and at entertainment venues, shows, and lodgings.
