Peru: Judiciary confirms seizure of book co-authored by Dina Boluarte

The Judiciary has confirmed the seizure of the publication "Aspectos legales en la responsabilidad médica en el Perú" (Legal aspects of medical liability in Peru) authored by Dina Boluarte and others, as part of the investigation they face over the alleged crime against copyright law.

Thus, the Supraprovincial Preparatory Investigation Court in Tax, Customs, Environmental, and Intellectual Property Crimes of Lima argued that said measure seeks to determine whether or not the beneficiary authors of the aforementioned text had included the respective quotes.

According to the resolution, this measure is necessary because the eventual loss or manipulation of the work "could mean a risk both for the right of the investigated parties to have the accusation clarified, as well as the obstruction of the prosecutorial activity by the Public Ministry and defenselessness of the aggravated parties."

"The purpose for which confirmation of seizure is requested is that it constitutes a source of material evidence, as it is the subject of an alleged crime, and the need to issue a seizure order on it is manifest to preserve and clarify the facts that are the subject of the investigation," the document pointed out.

As is known, the Prosecutor's Office conducts an investigation against President Boluarte and the other authors of the aforementioned work for the alleged commission of the crime against copyright law, plagiarism, provided for in article 219 of the Penal Code.
