Former La Libertad Region Governor and former presidential candidate Cesar Acuña Peralta was sentenced by the Judiciary to an 18-month suspended prison term for the crime of violating freedom to work.
Based on various media reports, the ruling was handed down by La Libertad's Single-Judge Criminal Court last May.
According to the same sources, which obtained a copy of the ruling, the former governor failed to comply with a final labor court judgment ordering the payment of S/88,525 (about US$26,106) to a retired teacher, who has since died and was represented by her son.
The amount corresponded to a bonus the deceased teacher had not received due to a miscalculation by La Libertad Region Government during Acuña's term in office.
However, considering that the former presidential candidate had no prior criminal record and was over 65 years old when the offense was committed, the prison term—which was initially set at two years—was reduced to an 18-month suspended sentence.
Thus, he will not serve time in prison.
The sentence was suspended on the condition that the convicted former official comply with several rules of conduct, including not changing his residence without prior court authorization, not committing another offense of a similar nature, and reporting to the Control Office every 30 days to account for his activities.
He must also pay S/97,377 (about US$28,716) to the late teacher's son.
This amount includes the compensation awarded in the labor case and S/8,852 (about US$2,610) in civil damages.
