Peru: Judiciary dismisses Pedro Castillo's appeal to annul presidential vacancy

The Judiciary dismissed the amparo appeal that ex-President Pedro Castillo had filed to annul the presidential vacancy, on the grounds of permanent moral incapacity, imposed by Congress in December 2022.

In this sense, the Third Constitutional Chamber of Lima's Superior Court ruled that the amparo (appeal for protection) raised by the ex-Head of State must be declared "unfounded in all its aspects."

Similarly, it considered that the presidential vacancy resolution approved on December 7 last year by Parliament "is duly reasoned."

Through his legal defense, Castillo alleged that Congress had violated due process and his right to defense, since he could not exercise it (his right) before Congress members, unlike what is established in current regulations.

Likewise, he requested that all actions taken by Parliament regarding his case be annulled and that he be reinstated to office.

Arguments

To this, the Judiciary responded by pointing out that the presidential vacancy "is duly reasoned," since it contains the factual reasons and the legal foundations that support it.


Furthermore, the ex-president's argument that the procedure to be followed was a constitutional accusation is refuted, indicating that the established steps to determine his vacancy were complied with, once it was confirmed his action was contrary to the legal, judicial, and constitutional order.
