Peru: Judiciary authorizes lifting of Pedro Castillo's bank secrecy

12:41 | Lima, Dec. 29.

The Supreme Preparatory Investigation Court on Friday confirmed the judicial order to lift the banking secrecy of the accounts and financial operations of ex-President Pedro Castillo, as well as of former Ministers Juan Silva (Transportation) and Geiner Alvarado (Housing).

This came after Judge Juan Carlos Checkley issued the resolution that consented to the execution of this measure required by the Public Ministry, after no appeal was filed by the parties to the proceedings.

"I order that the Superintendence of Banking, Insurance, and Private Pension Fund Administrators proceed with said lifting and comply with submitting each of the information (items) required by the Prosecutor’s Office, for the period from April 12, 2021, to December 31, 2022," the resolution added.

Thus, it also ordered that the measure be executed by the Second Transitory Supreme Prosecutor's Office Specialized in Crimes Committed by Public Officials.

It must be handled in a confidential manner, and its results must be presented to both the Judiciary and those affected, in compliance with the Procedural Penal Code.

Among the information to be required by the Prosecutor's Office are "account statements linked to savings deposits, current accounts, Service Time Compensation (CTS) deposits, requests for rental of safe deposit boxes (including details of where they are exactly located), as well as any another form of savings and investments canceled and/or in force."

Other operations are also indicated, such as "transfers and remittances of local funds, as well as transfers abroad via Swift, the Internet, or others, using accounts and without using accounts."

"In general, all those operations and services not previously mentioned that represent obligations for the client," the document added.

The ex-president and former ministers are charged with the alleged commission of various offenses, including (being part of a) criminal organization, influence peddling, and collusion to the detriment of the Peruvian State
