The Government has extended the duration of the state of emergency in the region of Lima, in the Constitutional Province of Callao, on Panamericana Sur, on Panamericana Norte, Central roads, as well as on Apurimac-Cusco-Arequipa and Interoceánica Sur corridors, for 30 calendar days, starting on February 14.
According to Article 166 of the Constitution, it is the primary duty of the National Police to guarantee, maintain, and restore internal order.
During this extension, the provisions of Subsection 1 of Article 137 of the Constitution —regarding the restriction and suspension of the exercise of constitutional rights relating to the inviolability of homes (expect on the aforementioned roads in the National Road Network), freedom of transit across the national territory, freedom of assembly, as well as personal freedom and security —included in subsections 9), 11), 12), and 24), paragraph f) of Article 2 contained in Peru's Political Constitution— will be fulfilled.
The intervention of the National Police and the Armed Forces takes place is in accordance with the provisions of Legislative Decree No. 1186, which regulates police use of force, and Legislative Decree No. 1095, which establishes rules for the use of force by the Armed Forces in the national territory and its Regulations, approved by Supreme Decree No. 003-2020-DE.
In addition, the National Police is required to present a full report of the actions carried out during the state of emergency and the results obtained, within five days after the end of said period.
Moreover, the implementation of actions provided for in the supreme decree is financed from the institutional budget of the specifications involved and from additional resource allocations authorized by the
Ministry of Economy and Finance (MEF).
Through Supreme Decree No. 009-2023-PCM,
the Government declared a state of emergency for 30 calendar days, starting January 15, 2023 in the regions of Cusco, Lima, and Puno, and the Constitutional Province of Callao, in the province of Andahuaylas in Apurimac region, in the provinces of Tambopata and Tahuamanu in Madre de Dios region, and in the district of Torata in Moquegua region.
