Peru: Gov't declares state of emergency in Callao, Cusco, Lima and Puno

The Peruvian Government has declared a state of emergency in various localities across the country, including the regions of Cusco, Lima, and Puno, and the Constitutional Province of Callao.

The measure was stipulated by Supreme Decree No. 009-2023-PCM, published on Saturday in the Official Gazette El Peruano.

The state of emergency will be effective as of today, January 15, and will last for 30 calendar days.

The measure will cover, in addition to the aforementioned jurisdictions, the province of Andahuaylas (Apurimac region), as well as the provinces of Tambopata and Tahuamanu (Madre de Dios region).

Similarly, the state of exception will be in effect in the district of Torata, in the province of Mariscal Nieto (Moquegua region).

Moreover, the measure also covers the following roads: Panamericana Sur, Panamericana Norte, Carretera Central, Corredor Vial Sur Apurimac-Cusco-Arequipa, and Corredor Vial Interoceanica Sur.

Suspension of constitutional rights

The exercise of constitutional rights relating to the inviolability of homes, freedom of transit across the national territory, freedom of assembly, as well as personal freedom and security, are restricted in the aforementioned localities.

On the other hand, the supreme decree states that, starting January 15 and for 10 calendar days, a mandatory curfew will be effective in the region of Puno from 8 p.m. to 4 a.m.

The rule provides that the intervention by the National Police and the Armed Forces takes place in accordance with the provisions of Legislative Decrees No. 1186 and 1095, which regulate the use of force by said institutions, respectively.

The supreme decree was signed by the President of the Republic Dina Boluarte, Prime Minister Alberto Otarola and the heads of the Defense, Interior, and Justice sectors.
