The Constitutional Court (TC) on Tuesday afternoon ordered the immediate release of
, who remains imprisoned at Barbadillo Prison in Lima's Ate district.
In this regard, the collegiate body's order asks the National Penitentiary Institute (INPE) and the director of the Barbadillo Prison to make the necessary arrangements for the immediate release of the ex-president during the day.
Moreover, the Court decided to severely reprimand the judge in charge of the Superior Court of Ica's First Preparatory Investigation Courtroom, Vicente Fernandez Tapia, for not implementing the resolution initially issued by the collegiate body.
As is known, the Constitutional Court's 2022 ruling was suspended by the Inter-American Court of Human Rights
(Inter-American Court), which required the Peruvian State to refrain from releasing Alberto Fujimori.
In this regard, the TC's order indicates that the Inter-American Court cannot command that said ruling not be implemented because it is outside its jurisdiction.
