Constitutional Court orders Odebrecht collaboration agreement to be open to the public

The Constitutional Court of Peru ordered that the effective collaboration agreement between the Special Team of the Prosecutor's Office that investigates the acts of corruption of Brazilian companies in Peru and the Attorney General's Office in the Lava Jato case, with the company Odebrecht, be made publicly accessible.

This was decided by the Second Chamber of the Constitutional Court when declaring founded the lawsuit filed by Edward Phillip Alexander Butters Rivadeneira against the Presidency of the Board of Superior Prosecutors of the Fiscal District of Lima Centro for having violated the fundamental right of access to public information.

In this regard, the court ordered the Presidency of the Board of Senior Prosecutors of the Lima Centro Fiscal District to deliver, within a period of no more than 5 business days, a copy of the Agreement of Benefits and Effective Collaboration dated February 15, 2019 and the Complementary Agreement dated May 20, 2019.

The ruling mentions that on June 29, 2023, Butters Rivadeneira filed a habeas data suit against the Presidency of the Board of Senior Prosecutors of the Lima Centro Fiscal District, in order to be given a certified copy of the effective collaboration agreement with Odebrecht and requested the protection of his right of access to public information.

"It is equally important to remember that whatever the reasons that led to establishing the confidential nature of a process, once it has concluded, by having a final or enforceable sentence, it allows its public character to be recovered in accordance with article 139, section 4 of the Constitution (...)", the document states.
