Peru Prosecutor: Preventive detention period of 36 months is adequate

Prosecutor Jose Domingo Perez has affirmed the preventive detention's maximum period of 36 months —established by law— is adequate, adding it contributes to appropriately carrying out investigations on complex corruption cases.

In this sense, Perez commented on the statements made by Judicial Branch Chairman Jose Luis Lecaros who considers the length is excessive.


In those cases, international judicial cooperation is needed in order to find the proof, which requires a specific period of time. 


Moreno is a fugitive from justice since last January when he was sentenced to five years in prison for another felony comprised in The Oquendo Estate Case.

Furthermore, Prosecutor Perez pointed out preventive detention requests are subjected to a judge's decision, who must review the evidence submitted by the Public Ministry. 

Moreover, he explained not all preventive detention requests are granted, such as the case of former Transport and Communications Minister Enrique Cornejo, among others. 

"We do not request it (preventive detention) on a whim. It is substantiated, and if we believe there can be another measure, then we request it (…)," Perez told RPP radio and TV station.

"The Prosecutor's Office does not request preventive detention left and right," he added.

In Peru, the Public Ministry is independent from the Executive Branch.
