Peru: President Balcazar enacts law recognizing bonuses and CTS for CAS workers

The government of President Jose Maria Balcazar enacted Law No. 32563, which introduces bonuses for Independence Day and Christmas, as well as Service Time Compensation (CTS), for workers under the Administrative Service Contract (CAS) regime.

The law, published on Monday in the Official Gazette El Peruano, amends Legislative Decree No. 1057.

It establishes that CAS employees will receive two bonuses per year, each equivalent to one monthly salary, in addition to the recognition of CTS as a labor benefit, calculated based on length of service and paid upon termination of the employment relationship.

With this measure, the Executive Branch strengthens social protection for thousands of State workers and advances the gradual improvement of their working conditions, in line with the principle of equity in the public sector.

Likewise, the law specifies the forms of hiring within the CAS regime, including open-ended contracts awarded through public merit-based competitions, as well as provisions to ensure job continuity and respect for workers' acquired rights.

For the implementation of these benefits, public entities at all three levels of government are authorized to make budget adjustments using their own resources, without requiring additional funding from the Public Treasury.

CAS-COVID

The Head of State also enacted Law No. 32566, which authorizes, on an exceptional and one-time basis, the conversion of CAS-COVID contracts to standard CAS contracts for healthcare personnel of the Social Health Insurance System (EsSalud) who provided services during the health emergency and were not covered by Law No. 31539.

The law aims to standardize the working conditions of this personnel and ensure their continuity in service, under equality criteria within the health system.

To qualify for this benefit, personnel must have worked under the CAS-COVID modality at EsSalud during the health emergency for a period of no less than one year.

They must not have been covered by Law No. 31539, must not have subsequently been hired under the regular CAS regime, and must not be employed under another labor regime in the public sector.

Furthermore, it establishes that EsSalud has a maximum period of 90 calendar days to carry out the contract conversion for workers who meet the requirements.

The implementation of this measure will be financed with EsSalud's own resources, without requiring additional funds from the Public Treasury.

Both laws bear the signature of President Jose Maria Balcazar, who reaffirmed the government's commitment to recognizing labor rights and improving working conditions in the public sector.
