Provincial Prosecutor Diana Liz Canchihuaman Castañeda, from the Lava Jato Special Team, has filed before the Judiciary the indictment against Pedro Pablo Kuczynski, Sergio Bravo, Alberto Pasco-Font, Jose Ortiz, among others, for the crime of collusion to the detriment of the Peruvian State.
This is due to the promotion process for awarding the road sections of the Northern Amazon Multimodal Axis (IIRSA Norte) in concession to the private sector (2003–2005 period).
In this case, the Public Ministry (Prosecutor's Office) representative has requested prison sentences of eight and a half years for Kuczynski and Jose Ortiz.
She has also requested nine-year sentences for Sergio Bravo, Alberto Pasco-Font, Glodomiro Sanchez, David Lemor, Rene Cornejo, Aldo Bresani, and Vicente Campodonico.
According to the prosecutorial indictment, Kuczynski took advantage of his position as Minister of Economy and Finance and Chairman of the Board at the State-run Private Investment Promotion Agency (ProInversion) from 2004 to 2005 to hold meetings with Jorge Henrique Simões Barata.
These gatherings were allegedly intended to favor the interests of the construction company Norberto Odebrecht (later Concesionaria Eje Vial Norte or Concesionaria IIRSA Norte S.A., made up of Norberto Odebrecht S.A., Andrade Gutierrez S.A., and Graña y Montero S.A.A.).
Such favoritism was allegedly obtained through the awarding of the contract and the concession agreement, to the detriment of the State's interests.
It resulted in an economic loss to the country equivalent to US$108,439,773.
This is the 31st indictment submitted by the Lava Jato Special Team for the corresponding legality review, a work that reaffirms the Public Ministry's firm commitment to pursuing criminal offenses.
