Peru: Judiciary orders reinstatement of Delia Espinoza as Attorney General

The Ninth Constitutional Court of Lima Superior Court of Justice ordered the reinstatement of Delia Espinoza as Attorney General, after declaring well founded the precautionary measure she had filed against the National Justice Board (JNJ).

The court on Monday ordered the "provisional suspension of the effects of the disciplinary administrative process that may have been initiated by the National Justice Board against the petitioner, Delia Milagros Espinoza Valenzuela."

Likewise, it required the National Justice Board to, within five days of being notified of the resolution upholding Espinoza Valenzuela's precautionary measure, comply with the judicial order and issue the corresponding administrative resolution.

On September 19, the National Justice Board  provisionally suspended Delia Espinoza as Attorney General for six months as part of the disciplinary process against her for not reinstating Patricia Benavides as head of the Public Ministry.

In its ruling, the Ninth Constitutional Court affirmed the validity of the acts through which the Board of Supreme Prosecutors, exercising the powers granted to it by the Constitution, appointed the petitioner, Delia Milagros Espinoza Valenzuela, as Attorney General for the 2024–2027 term.

In statements to a digital news outlet, the magistrate welcomed the court ruling reinstating her as Attorney General. Espinoza also announced that she will redouble her efforts and work at the Public Ministry (Prosecutor’s Office).

"I am going to resume my duties, address what is pending, and reopen, continue, or strengthen whatever needs to be done, because justice must prevail and the truth must come to light," she stated.

The magistrate reminded citizens that the 2026 General Elections are approaching, adding that the Public Ministry serves as a guarantee for the electoral process.

"If the Public Ministry is alert and vigilant in pursuing the crimes of those who deserve to be investigated and even prosecuted, we will be there—without political partisanship, without favoritism, without causing unnecessary harm, simply fulfilling our constitutional duty," she concluded.
