The Executive Branch on Friday enacted the law that establishes the destination of the corpses of inmates, who had been serving sentences for crimes of treason or terrorism in their capacity as heads, ringleaders, or core members of a terrorist organization.
The legal device has the objective of incorporating article 112-A to the General Health Law (Law 26842), thus allowing the competent prosecutor to order the cremation —after a necropsy— of the deceased sentenced terrorist in a reasoned and uncontested decision when the handing over of the dead body, its transfer, or burial puts national security or internal order at risk.
Cremation is carried out in the presence of a Public Ministry representative —for identification purposes— who draws up the corresponding certificate.
The
Ministry of Justice-Human Rights orders the dispersal of the cremated remains in a time and place of a reserved nature. It will rely on support provided by the Ministry of Interior.
