Peru: Attorney General Office files constitutional complaint against President and others

The Attorney General's Office, through the Illicit Enrichment and Constitutional Complaints Section, filed a constitutional complaint against the President of the Republic, Dina Boluarte, and others for the deaths of citizens during the social protests that occurred between December 2022 and February 2023.

The complaint also includes former Prime Ministers Pedro Angulo and Alberto Otarola; former Interior Ministers Cesar Cervantes, Victor Rojas, and Vicente Romero; and former Defense Minister Jorge Chavez Cresta.

They are accused of alleged crimes of aggravated homicide, serious injuries and minor injuries due to eventual intent, in the context of serious human rights violations against the deceased and injured citizens referred to in these complaints.

The alleged events refer to the social protests that occurred in the period between December 7, 2022, and February 9, 2023, in Apurimac, Arequipa, Ayacucho, Cusco, Junin, Ucayali, Puno, Lima, and La Libertad regions.


According to the statement from the Attorney General's Office, a total of 44 fatalities were registered (41 due to gunshot wounds and 3 due to blunt force trauma), along with 116 individuals sustaining serious and minor injuries (78 caused by gunshot wounds, 27 by blunt objects, 6 by tear gas bombs, and 5 by other objects).

The Attorney General's Office also reported that there are 303 prosecutorial files investigating 824 individuals for alleged crimes including obstruction of public services; attacks against public transportation; homicide; injuries; and others against the Peruvian State, law enforcement members, and other citizens, within the context of the protests.

The Attorney General's Office is independent from the Executive Branch.
