The Specialized Transitional Asset Forfeiture Court of Lima has declared a lawsuit over asset forfeiture admissible, so that eight real estate assets owned by
Peru's ex-President Alejandro Toledo, his wife Eliane Karp, and his mother-in-law Eva Fernenbug can become property of the State.
The lawsuit, presented by the Prosecutor's Office, also requests that a bank account belonging to Eva Rosa Fernenbug worth US$42,237 be declared forfeited and that the amount be transferred to the State.
Two real estate properties, owned by Toledo-Karp spouses, are located in the town of Punta Sal (Tumbes region) and in the Camacho neighborhood in Lima's La Molina district.
Likewise, a house, an office, three parking lots and two warehouses, located in Lima's Santiago de Surco district, are owned by Fernenbug.
The lawsuit was filed by the Sixth Transitory Provincial Prosecutor's Office for Asset Forfeiture in compliance with Legislative Decree No. 1373, mainly against assets and fortunes allegedly acquired as a result of illegal activities, which happens outside of criminal proceedings.
In the ruling, the court calls on defendants to respond to the lawsuit within the deadline, under penalty of declaring their rebellion, in case of non-compliance.
The former president arrived in Peru on Sunday morning. He was extradited from the United States to be brought before the Peruvian justice system for the prosecution of corruption cases that he was accused of regarding the concession for the construction of the South Interoceanic Highway.
The aircraft that transported him landed at Jorge Chavez International Airport, at about 7:00 a.m. (local time), half an hour earlier than expected (7:30 a.m.).
Toledo was brought to his native country after six years in which Peruvian authorities requested his extradition.
Alejandro Toledo —who resided in the U.S.— is being investigated by the Peruvian justice for having allegedly received a bribe worth US$35 million from Brazilian construction companies to favor them in the bidding for the South Interoceanic Highway, while he was President of the Republic (2001-2006).
