Peru's President: Institutional crisis reflected in TC's decision on Fujimori's pardon

The President of the Republic Pedro Castillo on Thursday affirmed that the institutional crisis, which he referred to in his address before Congress, is reflected in the recent decision of the Constitutional Court (TC) on ex-President Alberto Fujimori's pardon.

In a post on Twitter, the Head of State referred to the TC's decision on Fujimori's case, noting that international justice bodies must safeguard the effective exercise of justice for the people.

"The institutional crisis I referred to in my address before Congress is reflected in the recent decision of the TC. The international justice bodies to which Peru is attached and the rule of law must safeguard the effective exercise of justice for the people," reads his tweet.

In his speech before Parliament, President Castillo emphasized that there is a legitimacy problem in the institutions sustaining democratic life, citing as an example the Constitutional Court, "which has only six members, five of which with their mandate expired, while the mandate of the sixth magistrate will expire soon."

Peru's Constitutional Court (TC) on Thursday declared the habeas corpus filed by the defense of imprisoned ex-President Alberto Fujimori (1990-2000) admissible and reinstated the pardon granted by former President Pedro Pablo Kuczynski in December 2017.

The Court's magistrate Eloy Espinosa-Saldaña said that the case was reported overnight and lacked information to reach a decision.

According to a statement issued by the TC, judges Ernesto Blume, Jose Luis Sardon, and Augusto Ferrero voted in favor of the appeal, while the magistrates who opposed it were Marianella Ledesma, Eloy Espinosa-Saldaña and Manuel Miranda.

Augusto Ferrero, in his capacity as Chair of the TC, used his casting vote.
