The Plenary of the
Chamber of Deputies approved on Tuesday night the delegation of legislative powers to the Executive Branch for 90 days on matters concerning citizen security and El Niño phenomenon, as proposed in the majority report submitted by the Constitution, Regulations, and Foreign Affairs Committee.
The delegation of powers was approved by 66 votes in favor, 34 against, and 24 abstentions, following a second vote on the majority report, which had been rejected in a previous vote by the lower chamber.
In the first vote, the report was rejected by 73 votes against, 49 votes in favor, and 2 abstentions.
However, to enable a second vote on the report, the Chamber of Deputies accepted a motion for reconsideration of the first vote, submitted by Deputy Roxana Rocha (Popular Renewal Party).
The petition was approved by 75 votes in favor, 33 against, and 16 abstentions.
Likewise, to achieve the required consensus, the Chamber of Deputies' chairman adjourned the plenary session on three occasions and convened the Board of Spokespersons to reach agreements among the various parliamentary groups.
The majority report granting legislative powers on 20 points concerning citizen security and El Niño phenomenon was promoted in the Constitution Committee by the Popular Renewal, Good Governance Party, Civic Works Party, and Now Nation parliamentary groups.
The proposal was presented by Constitution Committee Chairwoman Giannina Avendaño (Together for Peru Party), who detailed the legislative powers concerning citizen security and El Niño phenomenon.
Regarding citizen security, she said, legislative powers are granted on matters such as migration and nationality; geolocation and identification of mobile devices; prisons and juvenile detention centers; legal-entity liability; firearms and explosives; and the judicial subsystem for combating extortion.
Regarding El Niño phenomenon, the legislative powers cover measures for the prevention, response to, and mitigation of climate-related disasters; humanitarian assistance by the National Civil Defense Institute (Indeci); agricultural sector and financing; machinery and complementary infrastructure; potable water and non-conventional sanitation; Works for Taxes; land title regularization, expropriation, and interference removal; and social housing and housing subsidies.
The debate
The proposal was approved following an intense debate that began at around 10:00 a.m., during which three committee reports from the Constitution Committee were debated and put to a vote.
They were the majority report submitted by the aforementioned committee, the minority report by Congressman Arturo Alegria (Popular Force), and another minority report by Anali Marquez (Together for Peru).
A fourth report, submitted by Deputy Jaime Abensur (Popular Force), was withdrawn to facilitate his fellow party member Arturo Alegria's proposal, which ultimately failed, despite the latter submitting a substitute text incorporating the 20 points from the majority report and nine additional matters beyond citizen security and El Niño.
During the debate, lawmakers from the four parliamentary groups that had previously submitted the majority report approved by the Constitution Committee said the effort made by these four groups to reach a consensus proposal should be recognized.
These views were expressed by Deputies Roxana Rocha (Popular Renewal), Angel Meneses (Now Nation), Heber Lopez (Civic Works Party), Rossana Loayza (Good Governance Party), Christian Aranda (Popular Renewal), Jose Marcelo (Now Nation), among others.
To the Senate
Following its approval by the Chamber of Deputies, the legislative proposal to delegate powers to the Executive Branch will be sent to the Senate for consideration by the relevant committees and the plenary session of the upper chamber for possible approval.
"Pursuant to Article 116(h) and Article 148 of the Chamber of Deputies' Regulations, the approved legislative proposal will be submitted to the Senate to continue the legislative process," Chamber of Deputies Chairman Oscar Reto stated at the end of this debate.
