The Constitutional Court (TC) has annulled the criminal proceedings that had sentenced former President Ollanta Humala Tasso to 15 years in prison for money laundering, after declaring well founded a habeas corpus petition filed by his defense, according to a ruling published the evening of July 30.
The ruling states that the TC resolved to "declare well-founded the petition, having established the violation of the principles of legality and specificity in criminal law, which are intrinsically linked to the right to personal liberty."
It also orders that "the entire criminal proceedings against Mr. Ollanta Moises Humala Tasso be declared null and void, in accordance with the reasoning set out in paragraphs 50 and 51 above."
The ruling was signed by TC magistrates Helder Dominguez, Francisco Morales, Gustavo Gutierrez, Cesar Ochoa, and Alfredo Hernandez.
"We are very pleased to have received a ruling that upheld the habeas corpus petition and, consequently, declared the entire proceedings null and void," Humala's lawyer, Wilfredo Pedraza, expressed.
The attorney said he would submit the TC's ruling to the appellate court currently reviewing Humala Tasso's case in order to secure his release.
"I hope that court can discuss it first thing in the morning. In reality, it only has to comply with this ruling and order Mr. Humala's release. By the afternoon, the National Penitentiary Institute (INPE) should carry it out after completing the corresponding administrative procedures," he told RPP Noticias.
It should be noted that the ruling includes dissenting opinions by TC magistrates Manuel Monteagudo and Luz Pacheco, who considered the habeas corpus petition filed by Humala to be inadmissible.
On April 15, 2025, the Judiciary imposed a 15-year effective prison sentence on former President Ollanta Humala for the crime of money laundering.
