Peru: Judiciary sentences Fernando Rospigliosi to nine-month suspended prison term

The Judiciary has sentenced acting Congress Chairman Fernando Rospigliosi to a nine-month suspended prison term for aggravated defamation to the detriment of former Attorney General Delia Espinoza.

The ruling against Rospigliosi was announced during the reading of the advance decision held Tuesday afternoon by the Supreme Single-Member Court.

The complete ruling against acting Congress chair will be issued on April 15 during a public hearing scheduled for 3:00 p.m. (local time).

The reading of the advance decision was delivered by Supreme Court single-judge magistrate Norma Carvajal, who stated that Rospigliosi must pay S/200,000 (about US$58,000) in civil damages to Valenzuela.

Similarly, the court imposed a 100-day fine on him, to be paid upon enforcement of the sentence in favor of the Peruvian State.

The sentence stems from a penal case filed by Valenzuela against Rospigliosi over comments and descriptions — including “pro-terrorist” — that he attributed to her while she was serving as Attorney General.

The ruling

"To convict Fernando Miguel Rospigliosi Capurro as the perpetrator of the offense against honor in the form of aggravated defamation, as provided for and punished under the third paragraph of Article 132 of the Criminal Code, to the detriment of Delia Milagros Espinoza Valenzuela," the ruling against Parliament’s head stated.

Likewise, it specified that the nine-month custodial sentence will be suspended for a one-year period, subject to a set of conduct rules that the Fuerza Popular (Popular Force party) legislator must observe.

The conduct rules are as follows: not to change residence; not to leave the city without prior notice to and authorization from the court; to report every 60 days to the judicial office for registration and biometric control, carrying his National Identity Document (DNI) to record his signature and justify his activities; not to commit a new intentional offense; and to comply with payment of the civil damages set in the ruling.

He was also ordered to pay court costs.
