Peru: Agreements on migration and border control entered into force starting today

The agreements adopted by the Council of Ministers on Thursday, concerning citizen and border security, as well as migration issues, have entered into force starting today, April 27, through the enactment of the corresponding legal regulations.

Thus, the declaration of state of emergency, for 60 calendar days, across districts in seven regions that encompass border areas with neighboring countries, was made official by Supreme Decree 055-2023-PCM, which was published today in the Official Gazette El Peruano.

The state of emergency covers several districts in the following provinces: Zarumilla (Tumbes region); Sullana, Ayabaca, and Huancabamba (Piura region); San Ignacio (Cajamarca region); Condorcanqui (Amazonas region); Maynas, Loreto, and Datem del Marañon (Loreto region); Tahuamanu (Madre de Dios region); as well as Tarata and Tacna (Tacna region).

The National Police of Peru (PNP) will be charge of maintaining control of domestic order supported by the Armed Forces within these jurisdictions, while carrying out border control operations.

Likewise, Supreme Decree 003-2023-IN amends various articles of the Migration Law (Legislative Decree 1350) in order to establish procedures to regularize the situation of foreigners who entered the country irregularly.

Furthermore, the validity of the Temporary Stay Permit Card (CPP) has been extended on an exceptional basis. The document will be valid for an additional 30 days if it expires after July 9, 2023. 

The above-mentioned decree is issued given that, in January 2023, according to information from the National Superintendence of Migrations, only 7,424 out of the 326,801 people who were granted the CPP are in the process to regularize their immigration status.

Amnesty for fines

Moreover, Law 31732, published today, approves an amnesty in the payment of fines for foreigners who, after having entered regularly to Peru, are now in an irregular situation.

The regulation, approved by Congress and enacted by the Executive Branch, establishes that said benefit has an irrevocable period of six months.

Those who fail to apply for an extension of their immigration status, within the time limit set, will be fined as well.

A complementary provision specifies that the National Superintendence of Migrations and the Ministry of Foreign Affairs will grant the immigration status to foreigners becoming victims of domestic violence, with children born in Peru or with a Peruvian spouse or partner.

At the time of this publication, the presentation to Congress, of a bill to amend Article 165 of the Constitution, by establishing that the support to be provided by military institutions in these areas will be permanent, was still pending.
