Cocktails Case: State Attorney's Office proposes civil compensation worth over US$39 mn

The State Attorney's Office against Money Laundering proposed a joint civil compensation worth S/151,063,509 (about US$39,953,322) expected to be paid by the defendants in the Cocktails case trial currently underway in Peru.

During the hearing held virtually on Wednesday, State Attorney's Office against Money Laundering representative, Soledad Camus, supported the claim for compensation.

The civil compensation is based on the alleged commission of the following offenses: being part of a criminal organization-illicit association (S/2,223,969 = US$588,196); money laundering (S/138,841,024 = US$36,720,715); obstruction of justice (S/305,856 = US$80,893), and statement in administrative procedure with generic falsehood (S/9,692,659 = US$2,563,517).

Similarly, she indicated that this civil compensation will allow extra-patrimonial compensation to the Peruvian State for both reputational and functional damage.

In this regard, the State attorney explained that the crimes committed by the defendants caused a loss of ethical values, which triggered corruption, generating decrease in trust and an increase in country risk, as well as reduction in credibility in institutions and inefficiency in complying with the law.

Furthermore, she specified that the requested civil compensation figure is based on the principle of equity. Since what was obtained cannot be returned, 50% of the amount linked to income from false content is requested proportionally.

"These amounts requested by the State Prosecutor's Office are not symbolic amounts, but equitable amounts that will compensate for the damage caused to the Peruvian State and fulfill the three functions of civil compensation," she stated.

On the other hand, the Court's head, Judge Juana Caballero, ordered that the oral trial continue on July 15 from 9:00 a.m. (local time).

The in-person hearing will be held at Carlos Zavala Loayza building, also in Lima.

At the upcoming hearing, the arguments of Fuerza Popular (Popular Force party) leader Keiko Fujimori's defense, as well as those of other defendants, will be presented.
