The legal defense of the
President of the Republic Pedro Castillo has filed a habeas corpus petition to declare void the agreement of the Parliament's Subcommittee on Constitutional Accusations that admitted a constitutional complaint against the Head of State for alleged treason against the country.
The habeas corpus petition was filed by Mr. Castillo's attorney, Eduardo Pachas, alleging violation of the right to individual liberty, due process, and due effective procedural protection in Parliament.
Similarly, the petitioner also alleged violation of the principle of legality and inapplicability by analogy of criminal law, as well as violation of the presumption of innocence and freedom of conscience.
The habeas corpus seeks to declare void the agreement of the aforementioned subcommittee, reached on February 28, which admitted the constitutional complaint for alleged treason against the country.
The habeas corpus also requested the withdrawal of the complaint for having violated due process.
On February 28, the Subcommittee on Constitutional Accusations declared a constitutional complaint against the President Castillo valid, approving —by majority— the qualification report presented by a group of lawyers and lawmaker Norma Yarrow (Avanza Pais).
In total, the report was approved by nine votes in favor and eight against.
In view of the tied vote, the chairman of the subcommittee, Rosio Torres (APP), used her casting vote and voted in favor of the report.
