Peru: Government officially declares state of emergency in Tacna districts bordering Chile

The Peruvian Government on Friday night officially declared a state of emergency in the districts of Palca, Tacna, and La Yarada–Los Palos (Tacna region), which are located in the border area with Chile.

This measure was officialized through Supreme Decree No. 135-2025-PCM, published in the special edition of the Legal Regulations Bulletin of the Official Gazette El Peruano.

Accordingly, a state of emergency is declared for 60 calendar days in the border districts of Palca, Tacna, and La Yarada–Los Palos to address crime and other violent situations.

The Peruvian National Police (PNP) maintains control of internal order, with support from the Armed Forces, and determines intervention areas based on intelligence, indicators, statistics, crime maps, and other tools.

The document specified that, during this period, the provisions of paragraph 1) of Article 137 of the Constitution apply regarding the restriction or suspension of constitutional rights related to the inviolability of homes, freedom of transit within the national territory, freedom of assembly, as well as personal liberty and security.

Likewise, it stated that, for carrying out religious, cultural, sporting, and non-sporting mass and public events, the corresponding permit must be requested from the competent authorities for evaluation.
Activities that are not of a mass nature may be carried out without prior authorization.

On the other hand, the regulation added that the intervention of the Police and the Armed Forces is carried out in accordance with the Legislative Decree regulating the use of force by the PNP, specifying the use of lethal and non-lethal weapons and adding the use of firearms in cases of flagrante delicto.

As well as in Title II of the Legislative Decree that establishes rules for the use of force by the Armed Forces in national territory and its regulations, and in the "State Joint Action Protocol for the Coordination of Services in Contexts of Detention, Retention, and Police Intervention Involving Women and Persons in Vulnerable Conditions."

Permanent session

The Supreme Decree added that the Tacna Regional Citizen Security Committee (Coresec), as well as the Command and established Committees, are declared in permanent session for the duration of the state of emergency.

Within 24 hours of the entry into force of this Supreme Decree, the Unified Operational Coordination Command (CCO) shall be established, as well as the District Coordination Committees (CCD), the Intelligence Committee (CI), the Oversight Committee (CF), and the Strategic Communication Committee (CCE), with members whose participation is non-delegable.

The response of the Public Ministry (Prosecutor's Office) and the Judiciary is also strengthened, and the expansion of online reporting is promoted.

Lastly, operations are ordered against illegal markets such as human trafficking, illegal drugs, weapons, SIM cards, and informal transportation, featuring multisectoral coordination to ensure security and internal order.
