The Congress of the Republic of Peru approved extraordinary regulations against the crimes of extortion and contract killings that affect public transportation and freight companies, which constitute an essential and strategic service for social mobility, employment, and the economy.
With 90 votes in favor, 2 against, and 3 abstentions, Bill 12723 was approved yesterday night. This bill, with a substitute text, proposes establishing extraordinary actions.
The initiative, which was exempted from a second vote, was authored by the President of Congress in charge of the Presidency of the Republic, Jose Jeri Ore. It consists of six articles and two final complementary provisions.
It was approved by the National Defense, Internal Order, Alternative Development, and the Fight Against Drugs; and the Transportation and Communications Committees.
The president of the Defense Commission, Karol Paredes Fonseca, explained that the ruling is based on the need for an exceptional state response to a structural and organized crime phenomenon.
This text was agreed upon by the participating institutions, such as the Ministries of the Interior, Transportation and Communications, the Judiciary, the Public Prosecutor's Office, the Ministry of Economy and Finance (MEF), Justice, and transportation unions, among others.
"Extortion and contract killings in public transportation affect not only the popular economy, but also the principle of legal certainty and the fundamental right to life," she stated.
Paredes Fonseca explained that the proposal includes the creation of a national registry of vulnerable transportation companies, the temporary intervention of routes and concessions at risk of criminal activity, and the exchange of information between the National Superintendence of Customs and Tax Administration (SUNAT), the Superintendency of Banking, Insurance and AFP (SBS), and the National Police to detect money laundering.
Likewise, special supervision of terminals is proposed for the Ministry of the Interior and the coordination of specialized prosecutors' offices for organized crime in related cases.
The extraordinary regulations proposed do not replace the ordinary criminal framework, but rather strengthen it with operational intelligence tools and inter-institutional coordination, stated the head of the National Defense Commission.
“This law constitutes a constitutionally legitimate and technically necessary response to restore confidence in the State and guarantee internal order. The National Defense Commission reaffirms the principle of citizen security as a superior legal right, Article 44 of the Constitution, which imposes on the State the duty to act preemptively, without waiting for the commission of serious crimes,” emphasized Congresswoman Paredes Fonseca.
Commitment
The president of the Transportation Commission, Juan Carlos Mori Celis, stated that the ruling is one of the agreements and commitments adopted in the seven working groups that have been held with the participation of the Executive Branch, the Judicial Branch, the Attorney General's Office, and the transportation unions.
“With the approval of this regulation, the agreement reached on October 2nd will be fully complied with. The main objective of this regulation is to establish an extraordinary legal framework that allows the State to prevent, confront, and remedy the effects of organized crime in the transportation sector, which involves extortion and contract killings through coordinated actions between various public entities, with an emphasis on financial and operational prevention,” he explained.
He also noted that the ruling documents more than 128 victims of attacks between August 2024 and October 2025; 65 deaths were recorded in Lima and Callao.
“Tax collection has become a criminal system of economic and territorial control. The current legal framework is insufficient, as the regulations in force do not allow for comprehensive or preventive action against crimes such as extortion and contract killings, which seriously affect citizen security and the right to work,” he stated.
