Peru: Habeas corpus requesting Fujimori's release dismissed

The Judiciary has dismissed the habeas corpus filed by Alberto Fujimori's grown-up children for his release from prison due to the coronavirus (COVID-19) pandemic.

According to the document, the ex-president (1990-2000) is the only inmate of the Lima-based Barbadillo Prison, making it very difficult for him to catch the COVID-19 disease. It added that he has enough space to carry out physical and intellectual activities in accordance with his status as a sentenced person.

"Therefore, there are no clear reasons that point to the probable imminence of becoming infected," it said.

In addition, it indicated that the restrictions of visits are favorable to him by not being overexposed to people who may have the virus, and stressed that the corresponding medical care is guaranteed by the constant presence of medical personnel and transportation assistance.

Likewise, it stated that the personnel caring for him are better trained than the common population in order to avoid exposure to the disease and not become a source of contagion.

The health emergency alone —from the legal point of view— does not allow the release of an inmate, it added referring to the fact that in the case of Fujimori there are no reasons to agree to such a request, read the document signed by Judge Adriana Zulueta.

Last week, Hiro and Sachi Fujimori filed a habeas corpus with the Supreme Court for the release of their father against a possible risk of getting the coronavirus.

As is known, Fujimori currently serves a sentence in prison over crimes of corruption and against humanity committed during his term in office.
