Peru: Government extends state of national emergency for 30 calendar days

The Peruvian Government has approved a supreme decree that extends the state of national emergency for 30 calendar days due to the serious circumstances affecting the life of people as a result of COVID-19. The extension will start on June 1, 2021.

Supreme Decree No. 105-2021-PCM provides that —during the extension of the state of emergency— the exercise of constitutional rights relating to personal freedom and security, the inviolability of homes, and the freedom of assembly, as well as transit across the national territory, are restricted.

Likewise, the regulation approves a series of measures that shall be implemented starting June 1, based on each region's alert level, in order to reduce the risk of COVID-19 contagion, which are listed below:

The Government ordered that the mandatory social immobilization (curfew) shall run until June 20, according to the alert level currently in place in each province and region, as stated below:

Moderate alert level: Monday-Sunday from 11:00 p.m. to 4:00 a.m.

High alert level: Monday-Sunday from 10:00 p.m. to 4:00 a.m.

Very high level: Monday-Sunday from 9:00 p.m. to 4:00 a.m.

Extreme alert level: Monday-Saturday from 9:00 p.m. to 4:00 a.m. and Sundays from 4:00 a.m. to 4:00 a.m. the next day.

Additionally, the use of private vehicles will be restricted until June 20, 2021, according to the alert level currently in place in each province and region, as stated below:

High alert level: Sunday

Very high alert: Sunday

Extreme level alert: Sunday

According to the alert level currently in place in each province and region, the following economic activities, as well as temples and religious sites, must comply with the following capacity limits:

a) Moderate alert level:

- Activities in closed spaces:

Casinos and slot machine halls, gyms, cinemas, and locations for performing arts: 50%

Malls, shopping arcades, department stores, shops in general, and conglomerates: 50%

Stores selling necessities, supermarkets, markets, itinerant markets, bodegas, and pharmacies: 60%

Restaurants and related facilities: 60%

Temples and religious sites: 50%

Libraries, museums, archaeological monuments, cultural centers and galleries: 60%

Sports associations facilities and clubs: 60%

Banks and other financial entities: 60%

- Activities in open spaces (without capacity limits, observance of protocols required, subject to local governments' authorization):

Restaurants and related facilities

Protected natural areas, botanical gardens, and zoos

Sports associations facilities and clubs

b) High alert level:

- Activities in closed spaces:

Stores selling necessities, supermarkets, markets, itinerant markets, bodegas, and pharmacies: 60%

Sports associations facilities and clubs: 50%

Banks and other financial entities: 60%

- Activities in open spaces (without capacity limits, observance of protocols required, subject to local governments' authorization):

c) Very high alert level:

- Activities in closed spaces:

Libraries, museums, archaeological monuments, cultural centers and galleries: 40%

Sports associations facilities and clubs: 40%

Banks and other financial entities: 50%

Interprovincial transportation by land means: 50%-100% capacity as regulated by the Ministry of Transport and Communications (MTC)

- Activities in open spaces (without capacity limits, observance of protocols required, subject to local governments' authorization):

Locations for cultural education

Restaurants and related facilities

Protected natural areas, botanical gardens, and zoos

Sports associations facilities and clubs

d) Extreme alert level:

- Activities in closed spaces:

Casinos and slot machine halls, gyms, cinemas, and locations for performing arts: 20%

Malls, shopping arcades, department stores, shops in general, and conglomerates: 20%

Stores selling necessities, supermarkets, markets, itinerant markets, bodegas, and pharmacies: 40%

Restaurants and related facilities: 30% (by appointment only)

Temples and religious sites: 20%

Libraries, museums, archaeological monuments, cultural centers and galleries: 30%

Sports associations facilities and clubs: 30%

Salons, spas, barbershops, as well as locations offering facial massages, manicures, make-up, and other related activities: 40% (by appointment only)

Banks and other financial entities: 40%

Interprovincial transportation by land means: 50%-100% capacity as regulated by the Ministry of Transport and Communications (MTC)

Restaurant delivery service: until 11:00 p.m.

Pharmacy delivery service: 24 hours a day
