This provision was established by declaring the appeal of citizen Carlos Hinostroza Rodríguez well-founded against the agreement of the Lima Municipal Council, which had rejected the request for removal from office in November 2021.
Hinostroza had requested the vacancy upon noticing that Muñoz Wells was serving as mayor while he was part of the board of directors of the State-run water company Sedapal, which —he indicated— contravenes the Organic Law of Municipalities.
The resolution by the JNE is unappealable and becomes effective following notification to the parties.
Current Deputy Mayor Miguel Romero Sotelo is likely to assume the post in Metropolitan Lima.
In November 2021, when the Municipal Council rejected the recall request, Muñoz indicated that "in light of the arguments presented" said request was "inconsistent."
Muñoz's term was initially set to end in December 2022.
