The declaration of state of emergency, for 60 calendar days, across various districts and provinces in the regions of Tumbes, Piura, Cajamarca, Amazonas, Loreto, Madre de Dios, and Tacna, which encompass border areas with neighboring countries, was made official by the Government of Peru.
The state of emergency covers several districts in the following provinces: Zarumilla (Tumbes region); Sullana, Ayabaca, and Huancabamba (Piura region); San Ignacio (Cajamarca region); Condorcanqui (Amazonas region); Maynas, Loreto, and Datem del Marañon (Loreto region); Tahuamanu (Madre de Dios region); as well as Tarata and Tacna (Tacna region).
The decree provides that the
National Police of Peru (PNP) is in charge of maintaining control of domestic order supported by the Armed Forces. To that end, the police determine the areas where such support is needed the most.
Likewise, during this state of emergency, the provisions of Subsection 1 of Article 137 of the Constitution —regarding the restriction and suspension of the exercise of constitutional rights relating to the freedom of transit across the national territory, freedom of assembly, as well as personal freedom and security— are fulfilled.
In addition, the intervention of the National Police and the Armed Forces takes place in accordance with the provisions of the legislative decrees that regulate the use of force by the National Police and the Armed Forces, and the Protocol of Joint Action by the State for the articulation of services in the context of police arrest, custody, and intervention of women and vulnerable people.
Furthermore, it provides that control and surveillance actions will be carried out within the framework of the
International Human Rights Law and taking into consideration the stipulations on the security cards in the areas close to the borders, bilaterally agreed by the Armed Forces of Peru and its neighboring countries, as appropriate.
