Public Ministry orders preventive detention in Peru's first international terrorism case

The Second Office of the Supraprovincial Criminal Prosecutor's Office Specialized in Terrorism and Related Crimes managed to get pre-trial detention orders against Iranian Majid Azizi, as well as Peruvians Luis Filomeno Loja Vasquez and Angelo Felipe Trucios Leon.

This measure was imposed over the alleged commission of conspiracy for the crime of terrorism to the detriment of the Peruvian State, as well as of Israeli citizens Gilad Duchovny, Ohad Duchovny, and Shachar Malka.

At this hearing, Province Prosecutor Diana Regalado supported the request by reporting on the carrying out of urgent and unpostponable investigative acts conducted in Lima and Cusco by prosecutorial and police personnel from the International Terrorism Investigation Division (Diviti).

These proceedings mentioned those investigated as subjects linked to a network belonging to the OTI (Islamic Revolutionary Guard Corps-Qods Force) that would commit a terrorist attack in Peru.

In addition, they stated that the investigation determined the existence of serious and well-founded elements of conviction, such as images, messages, audio recordings, testimonies, examinations, and international information, among others, that point to Majid Azizi as the person who last March contacted those Peruvian citizens included in the investigation.

His aim was to plan the murder of Shachar Malka —an Israeli national who resides in Cusco— offering to pay travel expenses and US$10,000 to the person who would materialize the crime.

Thus, the forcefulness of the prosecutor's thesis regarding the commission of the crime of conspiracy for the crime of terrorism committed by those investigated became successful.

In its decision, the National Preparatory Investigation Court declared the prosecutor's requirement for 18-month pre-trail detention of three of those under investigation well founded.

Likewise, it ordered the appearance with restrictions measure for the fourth of those investigated, Walter Oswaldo Linares Solano. He must also pay a bond worth S/5,000 (about US$1,356) within a period of 30 days. By judicial order, he is not allowed to travel abroad.
