Peru: Prosecutor's Office reiterates request for 15-year prison, 9-year ban on Vizcarra

The Public Ministry (Prosecutor's Office) on Thursday reiterated its request for a 15-year prison sentence and nine (9) years of disqualification from holding public office for former President Martin Vizcarra.

The Public Prosecutor's Office also requested that the former Head of State pay S/151,580 (US$44,953) in fines for accrued daily penalties.

During the closing arguments hearing in the criminal case against the former president, conducted by the Fourth Criminal Collegiate Court of the National Superior Court, anti-corruption prosecutor German Juarez Atoche presented his requests.

The magistrate also asked that, if he is found guilty, it be enforced immediately.

"I request that the sentence, if he is guilty, given the abundance of evidence presented by the Public Ministry, be enforced once it is handed down," he stated.

The prosecutor explained that, given the volume of evidence presented by the Prosecutor’s Office, the presumption of innocence of Vizcarra has been "broken."

The criminal case against the former head of state concerns the alleged bribes worth S/2.3 million (US$682,088) that he is said to have received for the awarding of the Lomas de Ilo Project and the Moquegua Hospital works.

Juarez Atoche specified that the Public Prosecutor’s Office is requesting six years in prison for the Lomas de Ilo case and nine (9) years for the Moquegua Hospital case, totaling 15 years for the alleged crime of passive bribery.

According to the anti-corruption prosecutor, in the Lomas de Ilo project case, Vizcarra is said to have requested an illicit payment of 2% of the project's value from the construction company Obrainsa. The public works’ value exceeded S/81 million (over US$24.02 million).

Regarding the Moquegua Hospital case, the awarding of the project was conditioned on the payment of S/1.3 million (US$385,528), the magistrate explained.

The closing arguments hearing in this criminal case continues, with the participation of representatives from the Office of the Attorney General.

As is known, Vizcarra was President of the Republic from March 23, 2018, to November 9, 2020, the day on which he was impeached and removed from office by Congress.
