Peru: Gov't makes state of emergency official, measure applies to Lima and Callao

Peru's Executive Branch, through a supreme decree, has officialized the declaration of the state of emergency in Metropolitan Lima and Callao region for 45 calendar days.

Supreme Decree No. 012-2022-PCM published in the Official Gazette El Peruano indicates that the National Police ensures the control of internal order supported by the Armed Forces.

During the extension of the state of emergency, the exercise of constitutional rights relating to personal freedom and security, the inviolability of homes, and the freedom of assembly, as well as transit across the national territory, are restricted.

The decree states that the intervention of the National Police and the Armed Forces is in accordance with the provisions of Legislative Decree No. 1186, which regulates police use of force, and Legislative Decree No. 1095, which establishes rules for the use of force by the Armed Forces in the national territory and its Regulations.

It also provides that the participation of local and regional governments in Metropolitan Lima and Callao region will take place within the framework of current regulations on citizen security.

In addition, it states that the implementation of the actions specified in this supreme decree will be financed from the institutional budgets of the departments involved, in accordance with current regulations.

As is known, the declaration of the state of emergency in Metropolitan Lima and Callao region was approved on Wednesday during the evening session of the Council of Ministers and was later announced by Defense Minister Jose Luis Gavidia at a press conference.
