Peru: Government officially declares state of emergency in Metropolitan Lima and Callao

The Executive Branch enacted Supreme Decree No. 035-2025-PCM, declaring a state of emergency in Lima Metropolitan Area and the Constitutional Province of Callao (Callao region).

The decree, published in an extraordinary edition of the Legal Norms Bulletin of the Official Gazette El Peruano on Monday, states that the declaration will remain in effect for 30 calendar days.

According to this document, the Peruvian National Police will maintain control of internal order, with support from the Armed Forces. Thus, the police will determine the areas requiring such assistance.

Article 2 states that the restriction or suspension of constitutional rights during the state of emergency follows the provisions of section 1 of Article 137 of the Political Constitution of Peru.

This applies to the restriction or suspension of constitutional rights concerning the inviolability of homes, freedom of transit within the national territory, freedom of assembly, as well as personal freedom and security, as established in items 9, 11, 12, and 24 (f) of Article 2 of the Constitution.

The intervention of the National Police of Peru and the Armed Forces will be carried out in accordance with Legislative Decree No. 1186, which regulates the use of force by the Peruvian National Police, and Title II of Legislative Decree No. 1095, which establishes rules for the deployment and use of force by the Armed Forces within the national territory, along with its regulations.

The implementation of the actions outlined in this decree will be financed through the institutional budget allocated to the budgetary units involved, as well as additional resource allocations authorized by the Ministry of Economy and Finance (MEF).

On Sunday night, Prime Minister Gustavo Adrianzen announced that the Executive Branch had ordered the declaration of a state of emergency in Lima and the Constitutional Province of Callao, with the deployment of Armed Forces troops in support of the National Police.
