Peru: Government extends state of national emergency for 28 calendar days

The Peruvian Government has approved a supreme decree that extends the state of national emergency for 28 calendar days due to the serious circumstances affecting the life of the nation as a result of COVID-19. The extension will start on February 1, 2021.

Supreme Decree No. 008-2021-PCM provides that —during the state of emergency— the exercise of constitutional rights relating to personal freedom and security, the inviolability of homes, and the freedom of assembly, as well as transit across the national territory, are restricted.

Likewise, the regulation approves a series of measures that shall be implemented from January 31 to February 14, based on each region's alert level, in order to curb the spread of the second wave of COVID-19, which are listed below:

The Government ordered that the mandatory social immobilization (curfew) shall run from Monday to Sunday, according to the alert level currently in place in each region, as stated below:

-Moderate alert level: from 11:00 p.m. to 4:00 a.m.

-High alert level: from 9:00 p.m. to 4:00 a.m.

-Very high level: from 8:00 p.m. to 4:00 a.m.

-Extreme alert level: from 12:00 a.m. to 11:59 p.m.

Regarding the extreme alert level (including Lima and Callao), citizens will be allowed to go out only to perform authorized activities.

In addition, each individual will be allowed to go out for one hour a day to nearby places between 6:00 a.m. and 6:00 p.m.

Targeted restrictions

Until February 14, 2021, the use of sand and stone beach areas, sea zone, river banks, lakes, and lagoons, is prohibited in Ica, Arequipa, Moquegua, Tacna, Tumbes, Piura, Lambayeque, La Libertad, Lima, and Ancash regions, as well as in the Constitutional Province of Callao.

Non-contact water sports are exempted from this restriction: surfing, sailing, rowing, among others, which take place exclusively in the sea area and with physical distancing.

The performance of non-contact water sports with physical distancing does not include the teaching of these sports disciplines.

Capacity limits at businesses 

-In regions under extreme alert, such as Lima and Callao, the capacity limit at casinos and slot machine halls, gyms, cinemas, and locations for performing arts (outdoor and indoor) will be 0%.

-At malls, shopping arcades, and department stores, shops in general, and conglomerates, the capacity limit will be 0%.

-In stores selling basic necessities, supermarkets, markets, itinerant markets, grocery stores, and pharmacies, the capacity limit will be 40%.

-At restaurants and related (indoor or outdoor) facilities, the capacity limit will be 0%.

-At temples and religious sites, the capacity limit will be 0%.

-At libraries, museums, archaeological monuments, cultural centers and galleries, botanical gardens, and zoos, the capacity limit will be 0%.

-At sports clubs and associations, the capacity limit will be 0%.

-At salons and spas, barbershops, and locations offering facial massages, manicures, make-up, and other related activities, the capacity limit will be 0%.

-At locations for sports and cultural education, the capacity limit will be 0%.

-At banks and other financial entities, the capacity limit will be 40%.
