"In practical terms, not to make a legal explanation, I believe that President Fujimori will not be released from prison until what is finally decided on the 6th (of April)," Nakazaki told RPP Noticias.
The lawyer specified that the
Inter-American Court will discuss on Friday whether or not the provisional or precautionary measures proceed; that is, whether the execution of
Peru's Constitutional Court sentence must be suspended until the hearing scheduled for the coming date.
In Nakasaki's opinion, the
Inter-American Court will be surprised to notice that the Peruvian State did not do what it had been ordered in 2018 when it indicated that, through an amparo proceeding and with the intervention of physicians, it should be checked whether Fujimori has illnesses which justify the granting of a humanitarian pardon.
In this sense, he stressed that the only matter the international court can point out is whether or not what had been ordered in 2018 was fulfilled.
"Given a host of errors, that has not been done; I hope the Court says: do what we ordered in 2018," he expressed.
The lawyer argued that his client's health problems, which —according to him— motivated the pardon in 2017, have now worsened and prompt him to require (additional) oxygen all day long.
The document also indicates that the measure would be applied temporarily, until the
Inter-American Court resolves the request for provisional measures in the cases of Barrios Altos and La Cantuta, in the event of Fujimori's eventual release.
