Peru approves rapid expulsion of irregular foreigners or those threatening public safety

The Peruvian Government has approved the Special Exceptional Administrative Sanctioning Procedure (PASEE), which enables the expulsion from the country, within a period of 48 hours, of foreigners with irregular migratory status or those whose illicit activities put public safety at risk.

The announcement was made by Prime Minister Alberto Otarola at a press conference on Monday.

The Cabinet chief explained that this measure will be possible thanks to the decision to amend Legislative Decree No. 1350 on Migration for improving immigration control, and to regulate the entry and exit of foreigners in Peru.

He went on to say that this amendment will allow the Peruvian National Police to hold foreigners with irregular migratory status for 24 hours, so that they can be immediately subjected to PASEE, which will be under the responsibility of the National Superintendence of Migrations.

In this instance, and in a single hearing, the National Superintendence of Migrations will have an additional 24 hours to determine the expulsion of foreigners from the country, or, otherwise, their impediment to enter.

This resolution will be immediately submitted to the Immigration Status Unit of the Peruvian National Police, to conduct the corresponding expulsion, pursuant to this new procedure.

Otarola affirmed that when applying this new procedure, Peru will be respectful of human rights, the right to a second instance, and the due process of foreigners in this condition, as demanded by international treaties.


In which cases does PASEE apply?

For his part, Interior Minister Vicente Romero explained that, with this legal amendment, the Peruvian National Police can proceed to the expulsion of any foreigner who is in an irregular immigration situation or those who carry out activities that put domestic order, public order, national security, or citizen security at risk.
