Congress officially approved the rule that allows passengers to endorse or transfer their airline ticket to another person free of charge, up to 24 hours before the flight, with the same terms of the contract of the original air ticket.
Furthermore, according to Law No. 32325, published today in the Legal Norms bulletin of the Official Gazette El Peruano, the airline is required to provide digital channels for this process and issue a new ticket free of charge for the new passenger.
If the airline unjustifiably refuses to endorse the ticket, it will be sanctioned by the aeronautical authority, except in cases of force majeure, according to the law.
The endorsement generates the issuance of a new ticket in the name of the endorsee, and its issuance is free of charge, according to the rule approved by insistence.
In all cases, the passenger will have the right to sue for damages, it states.
The Executive Branch will adapt the Regulations of Law 27261, the Civil Aeronautics Law of Peru, approved by Supreme Decree 050-2001-MTC, to the amendments provided for by this law, within 30 business days of its entry into force.
