Constitutional complaint filed against three Constitutional Court judges

Congresswoman Ruth Luque filed a constitutional complaint against Augusto Ferrero Costa, Jose Luis Sardon de Taboada, and Ernesto Blume Fortini, magistrates of the Constitutional Court of Peru (TC).

According to the document presented to the Congress' Subcommittee on Constitutional Accusations, the complaint was filed on the sentence that reinstated the humanitarian pardon granted to ex-president Alberto Fujimori (1990-2000).

Luque explained that the judges have infringed articles 51 and 55 of the Constitution, as they have violated the principle of legal and valuation supremacy of the Magna Carta; and of article 139, paragraph 3, for affecting the right of effective judicial protection of the victims.

Likewise, the parliamentarian accuses them of allegedly committing the crime of perversion of justice, for having issued a sentence that is contrary to the Constitution.

"We need an independent Constitutional Court that ensures the validity of human rights," Luque said in a post on Twitter.

The three magistrates voted to uphold the habeas corpus petition presented in favor of Fujimori Fujimori, which was declared admissible thanks to the casting vote of Augusto Ferrero, in his capacity as Chair of the TC.
