Peru: Executive Branch introduces bill to strengthen governance and confidence

The Government has introduced a constitutional reform bill that seeks to strengthen governance and confidence between the Executive Branch and Congress of the Republic.

In this context, the bill proposes the amendment of article 113, paragraph 2; article 114, paragraph 1; and articles 130, 132, and 133 of the Political Constitution of Peru.

In the case of article 113, it states that the Presidency of the Republic becomes vacant by reason of permanent mental or physical incapacity (of the President), which is incompatible with the exercise of the functions, duly accredited by a medical board and declared by no less than two thirds of the total number of Congress members.

Regarding article 114, it indicates that the exercise of the Presidency is suspended by reason of temporary mental or physical incapacity of the President, which is incompatible with the exercise of the functions, duly accredited by a medical board and declared by no less than two thirds of the total number of Congress members.

As for article 130, it states that the presentation of the Government's general policy, carried out by the President of the Council of Ministers within the first 30 days in office, shall not give rise to a vote of confidence.

With regard to article 132, it underlines that the motion of censure against ministers only applies to matters related to the exercise of the position, and that the President of the Council of Ministers or ministers must resign if censured. If the President of the Council of Ministers resigns, the other ministers must resign too.

Finally, in the case of article 133, it says that the motion of confidence applies to matters within the jurisdiction of the Executive Branch related to the Government's general policy, the Executive Branch's ordinary legislative initiative, and the continuity of Ministers of State.

"The motion of confidence does not apply to matters affecting the exclusive and excluding powers of the Congress of the Republic or other constitutionally autonomous bodies," it adds.

The bill was signed by the President of the Republic Pedro Castillo and Prime Minister Mirtha Vasquez, who attached an official letter by which they request Congress Chairwoman Maria del Carmen Alva to get it processed as a matter of urgency.
