Peru: JNJ ousts Patricia Benavides as Supreme Prosecutor and Attorney General

The National Justice Board (JNJ) on Wednesday unanimously decided to remove Liz Patricia Benavides Vargas from the position of Supreme Prosecutor and, consequently, of Attorney General.

The Five JNJ members voted in favor of the report that recommended the dismissal from office. They are Antonio de la Haza (chairman), Imelda Tumialan, Maria Zavala (rapporteur), Marco Tulio Falconi, and Guillermo Thornberry.

The document by magistrate Zavala recommended the dismissal after having proven Benavides' interference in the investigation into her sister, Judge Enma Benavides, and for having removed Prosecutor Bersabeth Revilla from her position without adequate justification and in a degrading manner. 

It was also proven that Patricia Benavides had favored Miguel Vegas by having appointed him Provisional Deputy Supreme Prosecutor despite the existence of disciplinary sanctions against him.


Enma Benavides and Azucena Solari dismissed

The JNJ also unanimously dismissed Provisional Supreme Prosecutor Azucena Solari and, by majority, Superior Judge of Lima, Enma Benavides Vargas.

Zavala's document proposed the dismissal of Solari given her performance as Provisional Supreme Prosecutor of the Second Transitory Supreme Prosecutor's Office for Crimes Committed by Public Officials.

It was proven that she had not acted independently and impartially by "uncritically" validating the report that served as a pretext to remove Prosecutor Revilla, thereby committing very serious misconduct.

Similarly, Zavala proposed the dismissal of Enma Benavides due to her actions as senior judge at the Superior Justice Court of Lima, since it was proven that she had interfered in prosecutorial function to improve her position in the criminal investigation against herself and for having lied to citizens in statements to the press about her disciplinary record.

It should be noted that judges Falconi and Thornberry adhered to Zavala's proposal, but expressed their disagreement over the recommendation to dismiss Enma Benavides and voted in dissent on that issue.
