Somos Peru party legislator Wilmar Elera has tendered his resignation as Third Vice-President of Parliament, after the
Judiciary sentenced him to six years in prison for the crime of aggravated collusion.
"I am pleased to address you to present my resignation from the position of Third Vice-Chairman of Congress of the Republic, to which I was lawfully elected in parliamentary elections on July 26 this year," he stated in a letter addressed to
Congress Chairwoman Lady Camones.
The lawmaker remarked that he does not agree with or accept the sentence that the Judiciary imposed on him. Consequently, he will challenge the decision in accordance with the provisions of the country's Constitution.
"In the exercise of my right to plurality of instances —provided under Article 139, paragraph 6 of the Political Constitution of Peru— I will be challenged at the appropriate time, sure and confident that a second instance with a better understanding of the facts and the evidence provided will absolve me of all responsibility," Elera stated.
Likewise, he emphasized that the sentence issued against him is not final and that he will approach the Supreme Court of Justice of the Republic and the Constitutional Court seeking protection of his fundamental rights.
Sentence
Judge Ronald Soto Cortez, of the Seventh Unipersonal Criminal Court Specialized in Corruption Crimes of Officials, sentenced Congressman Wilmar Elera to six years in prison for the crime of aggravated collusion.
In advance of the ruling, Judge Soto sentenced Elera for facts that date back to 2012 and that have to do with his participation as supervisor of the public work "Improvement and Expansion of the Potable Water and Sewage System of Pacaipampa, Ayabaca, Piura."
The full reading of the sentence will take place on August 11. On said date, the judge will present the arguments supporting his decision.
