Peru: The reasons for Jose Luna Galvez's house arrest

On December 31, Peruvian Judge Jorge Chavez Tamariz ordered the 36-month house arrest of former Congressman and Podemos Peru party founder Jose Luna Galvez, who is involved in Los Gangsters de la Politica (The Politics' Gangsters) Case.

The judge made this decision based on Luna's alleged health condition.

During the hearing, Chavez Tamariz indicated that —although the former Congressman is stable— it must be taken into account that he had undergone heart surgery, suffers from high blood pressure, is 65 years old, and had COVID-19.

"Said medical condition would put his health at risk if incarcerated. For that reason, I believe a less severe measure should be imposed," the judge explained.

However, Prosecutor Sandra Castro, who had requested the preventive detention, stated that Jose Luna Galvez's house arrest puts the ongoing investigation at risk.

According to Castro, the judge took into account the serious health condition that the accused had gone through. Nevertheless, Luna's physicians have pointed out in a report that "he had already overcome these issues."

Obligations

The former Congressman and entrepreneur must pay a bond of S/500,000 (about US$138,888) in the next 15 days.

Likewise, he has been prohibited from communicating with co-defendants (including his son, Podemos Peru party Congressman Jose Luna Morales), talking to the media, or holding meetings at his home.

With regard to other people involved in the case, the Judicial Branch imposed rules of conduct and the payment of bonds of S/50,000 (around US$13,888) by each one of them: Oscar Nieves, Fernando Obregon, and Laura Silva.
