Peru authorizes the use of stun guns for non-police municipal security guards

Peru’s Government enacted Law No. 32312, authorizing the use of stun guns by municipal security personnel as a means of defense in the fight against citizen insecurity.

The law published today in the Legal Norms bulletin of the Official Gazette El Peruano, modifies article 20 of the Municipal Guard Service Law, in order to authorize the use of a stun gun as means of defense for municipal guards.

The use of a stun gun is to prevent and deter the commission of crimes and offenses that threaten citizen security, while respecting the fundamental rights of individuals.

The Law No. 33212 also point out that municipal guards before using stun guns must be previously trained, in field, at shooting ranges and digital simulators.

The law also requires the Ministry of the Interior to evaluate whether the municipal security personnel the use of stun guns must use active body-worn video cameras.

The norm also establishes that municipal security personnel who, in the performance of their duties and using a means of defense as required, cause harm to life, limb, or health are exempt from criminal liability.

Last Saturday, Peru president Dina Boluarte signed the aforementioned law at a ceremony in which she swore in thousands of members of neighborhood councils from all districts of Lima and Callao.
