Peruvian court rejects former President Alejandro Toledo's request for release

He filed an appeal seeking redress for the 8 months and 3 days he was detained in USA

The Permanent Criminal Chamber of the Supreme Court dismissed the appeal filed by former President Alejandro Toledo, seeking accrual of the 8 months and 3 days he spent detained in the United States and his release due to the expiration of his pretrial detention period in the Interoceánica Sur case, sections 1 and 2.

The former president's legal defense argued that Toledo Manrique had already served the 18 months of pretrial detention ordered by Judge Richard Concepción Carhuancho, adding the time he spent in the United States and in the Barbadillo prison.

However, the Supreme Court clarified that the pretrial detention period is monitored from the date of his extradition, so the time he spent in the United States is not taken into account.

Thus, the Judiciary dismissed the former president's appeal to overturn the ruling issued by the First National Criminal Appeals Chamber on April 2, 2024.

 
The Judiciary also noted that Toledo Manrique has two other current pretrial detention orders for the Ecoteva and Interoceánica Sur cases, section 4.

Furthermore, on October 21, 2024, the former head of state was sentenced to 20 years and six months in prison after being found guilty of collusion and money laundering in the Interoceánica case, sections 2 and 3.

The former president has been held in the Barbadillo Penitentiary since April 23, 2023, the date he was extradited from the United States to Peru.
