The
(Prosecutor's Office) warned that if Congress modifies the Asset Forfeiture Law, a large portion of the 5,500 ongoing investigations would be shelved due to the lack of a final ruling, including six emblematic cases.
"This tool, key to seizing assets from corruption, drug trafficking, extortion, money laundering, and other crimes, could be at risk: action would only be taken with a final conviction," the institution stated on its X social media account on Monday afternoon.
Below are the cases at risk if the proposed amendments to the Asset Forfeiture Law are approved:
-Vladimir Cerron (former Junin Region governor) is being prosecuted for organized crime and money laundering. More than S/1.5 million (US$408,000) in his bank accounts has been seized.
-Rodolfo Orellana (lawyer) is being prosecuted for corruption of public officials, organized crime, money laundering, and others. Three properties in Lima, registered under frontmen, and the Cazaderos Estate, valued at S/130 million (US$35.38 million), have been seized.
-Alejandro Toledo (former President of the Republic) is being prosecuted for collusion, influence peddling, and money laundering. Properties in Las Casuarinas, Camacho, and Torre Omega, located in Lima's Surco district, and in Punta Sal (Tumbes region), worth over US$5 million, have been confiscated.
-Pedro Pablo Kuczynski (former President of the Republic) is being prosecuted for money laundering. A house and another property in Lima's Cieneguilla district have been seized.
-Florindo Eleuterio Flores Hala, alias 'Artemio,' (Shining Path terrorist group member), is being prosecuted for money laundering, drug trafficking, and terrorism. A property has been confiscated.
-Martin Vizcarra (former President of the Republic) is being prosecuted for offense against public administration, including the Moquegua Hospital and Lomas de Ilo cases. Fifteen properties located in Lima and Moquegua region have been seized.
"If the law is amended, the (Peruvian) State will recover nothing. The corrupt win!" the Public Ministry stated.
