Peru Gov't granted special powers to legislate on coronavirus-related matters

Peru's Congress granted special powers to the Executive Branch to legislate —for 45 days— on matters linked to the implementation of the state of national emergency declared amid the coronavirus (COVID-19) pandemic.

The proposal was passed Thursday by majority vote, with 65 votes in favor, 12 against and no abstentions.

It must be noted the Government has not been granted powers to legislate on item 11 —referring to control— through which the Executive Branch expected the Comptroller's Office could implement concurrent and subsequent control procedures to the acquisitions and investments made within the framework of the current health emergency.

Additionally, lawmakers have reduced the period that the Executive Branch could command legislative powers from 60 (as requested in the bill) to 45 days.

The Government asked for special powers to legislate on subjects related to health, fiscal and tax policy, public investment promotion, citizen security, among others.

In previous statements, President Martin Vizcarra has explained that these matters are related to aspects that guarantee the progress of the actions taken within the framework of the state of national emergency.

The top official affirmed that this was one of the issues addressed by the Council of State held last Monday, taking into account that Congress —due to the state of emergency— cannot establish commissions or internal bodies, and it becomes necessary to have a solution to the regulations.
