Peru's Prosecutor: Collaboration agreement with Odebrecht was never disregarded

Lava Jato Case Special Prosecution Group Coordinator Rafael Vela on Wednesday affirmed that his team never failed to comply with the effective collaboration agreement signed with Odebrecht —commenting on the decision by the Federal Public Ministry of Brazil which determined the suspension of the legal cooperation agreement with Peru, after a request from said company.

"There is a series of attribution of acts, which of course we are going to explain in due course rejecting them, because we are certain that we had not failed in any case to respect the terms of the effective collaboration agreement, the terms of Peruvian law and the foreign one," he said in remarks to RPP Noticias.

Vela recalled that last week Prosecutor Jose Domingo Perez —a member of the special team— carried out proceedings normally and had not noticed any type of controversy or dissatisfaction on the part of Odebrecht.

As he mentioned, the company (now called Novonor) alleges "apparent dissatisfactions and past reasons" and does not accept its presence as a witness at international arbitrations related to projects: Rutas de Lima and Gasoducto del Sur (Southern Gas Pipeline).

After explaining that to date they have not been notified of the decision by the Brazilian Prosecutor's Office, Vela indicated that the suspension of the agreement would be temporary, and he could not affirm that trials are harmed.

Later, on radio Exitosa, Vela dismissed that what was advanced in the Odebrecht case, as well as the statements made by its executives, had been invalidated with the suspension of cooperation.

He also announced that the team will prepare a report with the position of the Peruvian Prosecutor's Office.

The Federal Public Ministry of Brazil determined the suspension of the legal cooperation agreement with Peru, linked to the Odebrecht case, following a request from the company, according to EFE.

The decision was made in response to a lawsuit by Novonor (formerly Odebrecht), which denounced the alleged violation by Peruvian authorities of the agreement signed by both parties, which includes the "non-use of evidence produced in Brazil" against the company in the jurisdiction.

The Brazilian body determined the "suspension, for now, of legal cooperation" with Peru until new clarifications are presented by Peruvian authorities regarding the "seriousness and credibility of the information" claimed by the company —according to a document dated October 31.
