Peru: Gov't declares state of emergency in Apurimac region for 60 days

The Executive Branch on Monday declared a State of Emergency for 60 calendar days in the provinces of Abancay, Andahuaylas, Chincheros, Grau, Cotabambas, Antabamba, and Aymaraes, located in the region of Apurimac.

"The National Police of Peru maintains control of internal order supported by the Armed Forces," Supreme Decree No. 139-2022-PCM published this afternoon in the Official Gazette El Peruano said.

Suspension of constitutional rights

Article 2 of the decree states that, during this period, the exercise of constitutional rights relating to the inviolability of homes, freedom of transit across the national territory, freedom of assembly, as well as personal freedom and security, are restricted.

The decree states that the intervention of the National Police and the Armed Forces is in accordance with the provisions of Legislative Decree No. 1186, which regulates police use of force, and Legislative Decree No. 1095, which establishes rules for the use of force by the Armed Forces in the national territory and its Regulations, approved by Supreme Decree No. 003-2020-DE, respectively.

In addition, the National Police is required to present a full report of the actions carried out during the state of emergency and the results obtained, within five days after the end of said period.

Moreover, Article 5 of the rule details that the implementation of actions provided for in this supreme decree is financed from the institutional budget of the specifications involved.

The supreme decree was endorsed by Prime Minister Pedro Angulo Arana, Interior Minister Cesar Cervantes, Defense Minister Luis Alberto Otarola, and Justice-Human Rights Minister Jose Tello Alfaro.
