Supreme Prosecutors' Board: Espinoza's appointment as Attorney General remains valid

The Board of Supreme Prosecutors, through an official statement, reaffirmed that Delia Espinoza's appointment as Attorney General remains in effect.

This statement comes after the National Justice Board (JNJ) decided to reinstate Patricia Benavides in the aforementioned position.

The Supreme Board recalled that the dismissal of Benavides had become final after being resolved in the last and definitive instance by the JNJ itself.

In light of this, and in accordance with Article 158 of the Constitution, the group convened a session to elect the Public Ministry's new head.

"In strict compliance with the procedure and the regulations governing it, the Supreme Board of Prosecutors adopted Agreement No. 6579-2024, dated October 18, 2024, electing Ms. Delia Milagros Espinoza Valenzuela to the position of Attorney General for the constitutional term of three years —a designation that remains in effect," its members stated in a release.

Regarding the situation of Patricia Benavides, the Board recalled that she was provisionally suspended during the proceedings before the JNJ.

However, a request for annulment filed by her was later declared unfounded, resulting in her dismissal and the cancellation of her title.

"This decision was the subject of a request for reconsideration, which was resolved by the National Justice Board on October 2, 2024, reaffirming its decision to dismiss Ms. Liz Patricia Benavides Vargas," the Board added in the statement.

Lastly, the Public Ministry reiterated its commitment and faithful fulfillment of its assigned duties, "one of which is the election of the Attorney General, entrusted to the Board of Supreme Prosecutors."
