Peru: Government extends state of national emergency thru June 30

The Peruvian Government has stipulated the extension of the national state of emergency for 30 calendar days, from June 1, 2022, due to the serious circumstances that affect the lives and health of citizens as a result of COVID-19.

The corresponding rule was published in the Official Gazette El Peruano on Thursday.

Supreme Decree No. 058-2022-PCM states that during the state of national emergency the exercise of constitutional rights related to personal freedoms and security, the inviolability of homes, as well as freedom of assembly and movement across national territory, are restricted.

They are included in paragraphs 9, 11, and 12 of Article 2, as well as paragraph 24, section f) of the same article in Peru's Political Constitution.

According to the document, there has been a slight increase in COVID-19 cases over recent weeks.

Among other aspects, the Ministry of Health (Minsa) recommends extending the national state of emergency for a period of 30 calendar days, as well as maintaining preventive measures and monitoring compliance with the social coexistence rules established.

In this line, the regulation indicates that the Peruvian State intervenes in the provision of medical care services, in accordance with the principle of equity.

Likewise, it is possible to establish limitations to the exercise of rights to property; the inviolability of homes; free transit; freedom of work, business, commerce, and industry; as well as the exercise of the right to assembly in protection of public health.


It was also inked by the Ministers of Interior; Defense; Foreign Affairs; Health; Justice-Human Rights; Development-Social Inclusion; Labor-Employment Promotion; Foreign Trade-Tourism; Transportation-Communications; Education; Economy-Finance; Energy-Mines; Housing-Construction-Sanitation; Agricultural Development-Irrigation; Production; Women-Vulnerable Populations; Environment; and Culture.
